These general conditions of sale are concluded on the one hand by the company My Qamis Homme (hereinafter referred to as “My-Qamis-Homme.com”)  and on the other hand, by any natural or legal person (hereinafter referred to as "the buyer") who makes a purchase via the website "My-Qamis-Homme.com"

Object :
These conditions of sale aim to define the  transaction terms  between My-Qamis-Homme.com and the buyer and the conditions applicable to any purchase made through the My-Qamis-Homme.com merchant site, whether the buyer is a professional or a consumer.
The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale.
These conditions of sale shall prevail over any other general or specific conditions not expressly agreed to by My-Qamis-Homme.com
My-Qamis-Homme.com reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the buyer.

CHARACTERISTICS OF THE GOODS AND SERVICES OFFERED:
The products and services offered are those which appear in the catalogue published on the My-Qamis-Homme website.
These products and services are offered while stocks last.
The photographs in the catalog are as faithful as possible but cannot ensure perfect similarity with the product offered, particularly with regard to colors.

PRICE :
The prices listed in the catalog are inclusive of all taxes in euros, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services. My-Qamis-Homme  reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated do not include order processing, transport and delivery costs provided that they take place in the geographical areas provided for below.

GEOGRAPHICAL AREA
The online sale of products and services presented on the site is reserved for buyers who reside in France, in the  DOM-TOM  or in Monaco and for deliveries required in these geographic areas.

In the event of delivery of a product outside the territory of the European Union and in the  DOM-TOM, the Buyer declares himself the importer of the product and accepts that in such cases My-Qamis-Homme  may be materially unable to provide him with exact information on the total amount of costs relating to customs duties and formalities or import taxes applicable in the country where delivery of the product is requested.

ORDERS
The buyer, who wishes to purchase a product or service, must:
– complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one;
– complete the online order form, providing all the references of the products or services chosen;
– validate your order after having checked it;
– make the payment under the conditions provided;
– confirm your order and payment.
Confirmation of the order entails acceptance of these conditions of sale, recognition of having full knowledge of them and the waiver of relying on one's own conditions of purchase or other conditions.
All data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out.
The seller will communicate by email confirmation of the registered order.
After payment, any modification of the order will be impossible. It is the customer's responsibility to check the details of his order before validation and payment: References, sizes, colors, quantities, delivery address, and delivery time of the selected carrier.

​  The customer must take into consideration that after payment and validation of the order, it is impossible for us to stop the shipment of the order for a question of logistics. In case of cancellation of the order, the customer will always have the possibility to return the package. The costs of returning the package and shipping will remain at his expense.

WITHDRAWAL
In accordance with the law, buyers, non-professional individuals  has a right of withdrawal within a period of 14 days from the date of receipt of his package without justification of reasons and without penalties. On the condition that the product(s) are returned in their original condition (new, unworn, unaltered, undamaged, in their entirety, with all their accessories, and in their original packaging). In the  otherwise,  My-Qamis-Man  reserves the right to refuse the customer's return.
If all conditions are met  reunited  The seller undertakes to reimburse the customer the total amount of the returned item(s) (excluding shipping costs) within 30 days of the request and subject to receipt by the seller of the returned product.
Any return made outside the withdrawal period will be systematically refused.
Sale items or items purchased with a gift card cannot be returned.
Return costs are the sole responsibility of the customer.
If the return is only partial, only the returned products will be  refunded  to the customer.
For orders that benefit from free shipping, a deduction of €5 will be taken from the total amount of the items.

The reason for return

We will respond to you within 48 hours and instructions will be provided to you.

If you are shipping an item over $75, you should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If your request is approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received your refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next, contact your bank. There is often some processing time before a refund is posted.

Payment in installments with Alma

Payment in installments/deferred payments is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.

Amount of purchases

  • P2X: Only purchases between 50  € and 2  000  € are eligible for payment with Alma.
  • P3X: Only purchases between 50  € and 2  000  € are eligible for payment with Alma.
  • P4X: Only purchases between 50  € and 2  000  € are eligible for payment with Alma.

Costs

By paying in installments with Alma, the Customer does not pay any fees.

Alma is a telepayment manager and issues an electronic certificate which will serve as proof of the amount and date of the transaction in accordance with the provisions of Articles 1316 et seq. of the Civil Code.

Termination

Any termination of the T&Cs binding the Seller and the customer shall result in the termination of the T&Cs between Alma and the customer.




Exchanges (if applicable)
Exchanges are not accepted, if you want another product. Please order it on our website and then return the product you want to return.

Gifts
If the item was marked as a gift when purchased and shipped directly to you, you’ll receive a gift credit for the value of your return. Once the returned item is received, a gift certificate will be mailed to you.

If the item wasn’t marked as a gift when purchased, or the gift giver had the order shipped to themselves to give to you later, we will send a refund to the gift giver and he will find out about your return.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable. If you receive a refund, the cost of return shipping will be deducted from your refund.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

Exchange :
From the date of receipt of the order, the customer has 14 days to return a product. After this period, the order will be considered by My-Qamis-Homme as compliant and accepted by the customer, so no return or refund will be taken into account.
After checking your return, we will issue a credit note that you will receive by email corresponding to the amount of the returned products. You will simply need to enter this discount code in the box provided for this purpose in the basket when you place your new order. This discount code is valid for 1 year.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.

Payment
The price is payable upon ordering.
The buyer's account will be debited when ordering the available products or services and the amount of the products or services sent.
At the buyer's request, a paper invoice showing the VAT will be sent to him.
We do not retain our customers' bank card details following payment.
Payments will be made by bank card.
Payments will be made by  PayPal or  bank card  via a secure payment module. The cards accepted are Carte Bleue VISA, Mastercard and American Express.
The customer can pay by  bank transfer. In this case, the order will only be validated after receipt of payment. Any costs will be borne by the buyer.  The information necessary to make these payments will be sent by email.

DELIVERIES
Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area.
Packages are shipped within 1 to 3 days.
Standard delivery: 2 to 10 business days after dispatch, depending on carrier delivery times.

The risks are the responsibility of the purchaser from the moment the products leave the premises of My-Qamis-Homme. In the event of damage during transport, a reasoned protest must be made to the carrier within three days of delivery.

Delivery times are given as a guide only.  indicative;  If these exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

My-Qamis-Homme is not responsible for the disappearance of packages after official deposit recorded by the carrier. Once your package is declared delivered, our responsibility is no longer engaged. No refund will be made in this case.

For deliveries to a relay point, the package must be opened and checked  before signing.
After validation by the customer's signature, no complaints will be possible.

My-Qamis-Homme cannot be held liable in the following cases:
- loss, theft or damage to a package during delivery regardless of the method of sending
- extension of delivery times due to the carrier
- returned packages in the event of inaccuracy or incomplete contact details provided by the customer.

Guarantee
For any complaints about your order, please contact customer service by email within a maximum of 72 hours of receiving your package.
The warranty is no longer valid  beyond  30 days from the date of receipt.
All products supplied by the seller benefit from the legal guarantee provided for by articles 1641 et seq. of the Civil Code.
In the event of any defect, non-conformity of the products with the order, the buyer  must report it by email. My-Qamis-Homme  will proceed, as the case may be, to the exchange or  the refund  products. Any claim made outside the legal deadline will not be accepted. The products must be returned to My-Qamis-Homme in the condition in which the buyer  received them intact and in their original packaging.

RESPONSIBILITY
The seller, in the online sales process, is only bound by an obligation of  means ;  It cannot be held liable for damage resulting from the use of the Internet network such as loss of data, intrusion, viruses, service interruption, or other involuntary problems.
The customer undertakes to provide My-Qamis-Homme with correct identification information, as well as any updates thereof.
In the event of incomplete or incorrect information provided by the buyer, My-Qamis-Homme.com cannot be held liable, nor can it give rise to a right to reimbursement or reshipment of the products concerned.

- all inconveniences or damages related to the use of the Internet network (a break in service, an external intrusion or the presence of computer viruses)
- any failure to meet its contractual obligations in the event of a major and/or unforeseen event, internal or external strike, disaster, fire, catastrophe, internal or external breakdown, and in general any incident which would prevent the proper processing of orders

All elements of the site "My-Qamis-Homme.com" are and remain the intellectual and exclusive property of My-Qamis-Homme.
No one is authorized to reproduce, exploit, rebroadcast, or use for any purpose whatsoever, even partially, elements of the site whether software, visual or audio.
All elements of the site  "My-Qamis-Homme.com", whether visual or audio, such as writings, videos, photographs, logos, are the exclusive property of the company My-Qamis-Homme. Any copy, adaptation, translation, representation or modification, even partial, of the site  "My-Qamis-Homme.com"  And  of its content is strictly prohibited without the prior written consent of My-Qamis-Homme and may be subject to legal action.

ENTIRE CONTENT
In the event that one of the general conditions of sale is null and/or void due to a change in legislation, regulation or by a court decision, this shall in no way affect the validity and compliance with these general conditions of sale at the time of validation of the order by the customer.

DISPUTE RESOLUTION
These online sales conditions are subject to French law.
In the event of a dispute, jurisdiction is assigned to the competent courts of Paris, notwithstanding multiple defendants or third-party claims.
